The state of New Jersey has based its overtime pay laws on the FLSA,the federal laws put in place by the Department of Labor to help make sure the workers of America are treated and paid in a fair manner. Under these laws, the following types of employees are not entitled to overtime pay in New Jersey:
- Professional
- Administrative
- Executive
Other types of employees who may be exempt from overtime pay in New Jersey include:
- Independent contractors
- Outside sales workers
- Transportation workers
- Some agriculture and farm workers
- People who reside and work at the same address
