Maine State Overtime Exemptions

Maine state overtime laws are closely based on the federal body of laws that regulates fair pay known as the Fair Labor Standards Act (FLSA). Under both sets of laws, the following types of employees are not entitled to (exempt from) overtime in Maine:

  • Professionals
  • Administrators
  • Executives

There are also other types of workers who may not be entitled to overtime pay in Maine. These may include:

  • Transportation workers
  • Agriculture and farm workers
  • Independent contractors
  • Outside sales professionals
  • Individuals who work and reside at the same place
