The current overtime law called the FLSA or Fair Labor Standards Act currently only covers 8% of workers in the U.S. In 1975 the FLSA covered 60% of workers in the U.S. But the Department of Labor has made changes to the law that are out for comment now. They are likely to become the law in the future–as soon as January 2016. With the changes, the FLSA will now cover over 40% of U.S. workers and even with inflation in the future the FLSA will be pinned to the 40th percentile of U.S. workers’ wages so it will continue to cover a large amount of workers.
Basically with the new change, managers and administratively exempt employees currently making $50,439 or less must be paid overtime for hours worked over 40 in a week. In the future that amount will be pegged to the 40th percentile of U.S. workers so many more will be permanently eligible for overtime.
