This week Google was sued in U.S. District Court, Southern District of New York for violations of the FLSA. The case is called Jacob McPherson vs. Google Inc et al., 14-9026. The allegation is that he was improperly classified as an independent contractor, even though he was allegedly worked at the Google New York office. The US Supreme Court has provided several factors to determine if someone is an independent contractor or employee. Typically if you work at the same company every day, at their offices, using their equipment you are an employee no matter what the contract says. It will be interesting to see how this one turns out. td
